Digital Decorator Terms & Conditions

This page together with the documents referred to on it tells you the terms & conditions on which we supply any of the products to you listed on our website www.digitaldecorator.co.uk. Please read the terms and conditions carefully before ordering any products from our site. You, the customer should understand that by ordering any of our products, you agree to be bound by these terms and conditions.

Custom Wallpaper

You understand that by paying for the item, you have approved the design you have created to proceed to production and it will be produced exactly as previewed. This includes layout, sizes and quantities. It is important that you check that the layout, sizes and quantities are correct prior to approval and payment. It is solely the customer’s responsibility to check these details prior to approval and payment.

Digital Decorator cannot be held responsible for any errors that are made with regards to the layout, sizes and quantities. You understand that once you have approved the digital proof (which appears on screen during the ordering process, before progressing to the basket checkout) and have paid for the item, a file of that design is digitally created automatically. Digital Decorator do not make any further amends to this design, the item goes into our print queue which may be printed out almost immediately. In the event you notice a mistake in the image you have approved, we may be able to make a change if we are contacted within 1 hour via email only, but it is not guaranteed. If we are able to make an amendment after the item has been paid for, we will make one manual amend free of charge. We are unable to process amends via telephone.

Images

You understand that the size of the file of the image you upload is directly related to the quality of the final printed image, and the image deteriorates the larger it is reproduced or printed. Digital Decorator cannot be responsible for the final printed outcome if the image you supply is of inferior quality or not suitable for the print size you require. Our quality meter will provide an indication of the expected image quality based on output size versus resolution of the original used. We will do our best to give you a quality finish but we cannot be held responsible for the end result if your original supplied image is poor. It is the customer’s responsibility to ensure that all colours, sizes, filter effects and cropping areas are correct.

Copyright

Images selected from our designer collection or from our stock image partner are automatically free of copyright and any usage licenses will have been paid for by Digital Decorator. By supplying us with your own image, you agree that you own the copyright or license or have the written permission of the copyright owner to use the photograph. Under no circumstances will Digital Decorator be responsible for any copyright issues arising as a result of you supplying us with any image or artwork that is in breach of copyright.

Our Right to Refuse Images

Digital Decorator holds the right to refuse images that are deemed of very low quality or are in contradiction with our business morals and principles. This may include but is not limited to, racially discriminating imagery, pornography, poor artwork, and immoral or illegal materials.

Price and Payment

The price of any product will be quoted on our site, except in cases of obvious error. These prices include delivery costs to mainland UK locations, overseas orders will incur additional shipping charges to be paid separately. Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an order confirmation. Transactions will appear as Digital Decorator on your Pay Pal account or credit/debit card. Digital Decorator is a trading name of Dot Pics Limited, registered in England No 04208741.

Delivery

We will endeavour to dispatch all wallpaper orders within three working days. Please allow up to five working days from the date of order for your wallpaper to arrive. Delivery will be provided by Royal Mail Tracked service and they may require someone to be present to sign and collect the package. It is the sole responsibility of the customer to ensure that someone is available to take delivery. Digital Decorator cannot be held responsible for any late, lost or unforeseeable event caused by a delivery date not being met. You shall be deemed to have accepted the goods after receiving delivery. The Products are the customer’s risk from the time of delivery.

Import Duties & Tariffs

If you order goods from our website for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

Damaged Items

We ensure all items are quality checked prior to dispatch. If your item has been damaged in transit, it is the customer’s responsibility to check the delivery before signing for it and we cannot refund any damaged deliveries that have not been logged by the courier at the point of delivery. In the event that your item is delivered damaged, we will endeavour to provide a replacement using the same delivery method. To consider a replacement, we require photographic evidence of the damage, including the packaging within seven working days of delivery to be provided via email.

Returns

If your order does not match the order you placed on-line, you have the right to return and to receive a full refund or the right to request a replacement, free of charge.

Our Copyright

All website design, text, graphic and designs of the products within the site are under strict copyright of Digital Decorator ©. You may not modify or replicate any item in any way without our permission. You are not permitted to copy (whether by printing off onto paper, storing on disk or in any other way), distribute (including distributing copies), alter or tamper with in any way or otherwise use any material contained on the Digital Decorator website.

Colour Matching

Please note we will try our best to ensure the closest colour match possible, however images and designs may vary slightly from the ones viewed on your computer, due to the difference between RGB (screen) and CMYK (print) processes.

Damage to Wall Surfaces

Digital Decorator accepts no responsibility for damage to wall surfaces as a result of the application of their product. It is clearly stated here that the selection of wall, wall surface, application paste and finishing methods are the choice and responsibility of the purchaser. Digital Decorator and its consumables suppliers will not accept any liability for any damages caused to wall finishes during installation.

Installation

Digital Decorator accepts that it is responsible for supplying a product perfectly cut and presented as ordered by our customer. Digital Decorator does not however accept responsibility for DIY installation problems or for mistakes in cutting, gluing, or fixing by the user. An installation guide is supplied with each delivery and if these guidelines are followed competently there should no issue. Digital Decorator does not accept responsibility for any damage that may occur from the removal or de-installation of their product – at any time.

Data Protection & Privacy

We value customer privacy, and work on a non-disclosure basis, we do not pass on client information to third parties (except for the needs of product delivery). In order to process an order we have to collect your name, billing address, delivery address, email address and telephone number(s). Events Outside our Control

We cannot be liable or responsible for any failure to perform, or delay in performance of any of our obligations under a contract that is caused by events outside our reasonable control (force majeure event). A force majeure event includes any act, event, non happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

  • Strikes, lock-outs, or other industrial action.
  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
  • Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
  • Impossibility of the use of public or private telecommunications networks.
  • The acts, decrees, legislation, regulations or restrictions of any government.

Our performance under any contract is deemed to be suspended for the period that the force majeure event continues, and we will have an extension of time for performance for the duration of that period. We will use all reasonable endeavours to being the force majeure event to a close or to find a solution by which our obligations under the contract may be performed despite the force majeure event.

Custom Designs

We retain the copyright and image rights to the design of any custom made design we may offer, sell or produce, and may use for resale in the future.

Entire Agreement

These terms & conditions and any document referred to in them represent the entire agreement between us in relation to the subject matter of any contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

Severability

If any of these terms & conditions or any provisions of a contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

Our Right to Vary these Terms & Conditions

We retain the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities. You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the despatch confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the products).

Law and Jurisdiction

Contacts for the purchase of products through our site will be governed by English Law. Any dispute arising from, or related to, such contracts shall be subject to the exclusive jurisdiction of the courts of England and Wales. These terms and conditions do not affect your statutory rights. Only persons aged eighteen years or over may agree to these terms and use the web site or the services offered through the web site.
